Terms and Conditions

By accessing or using the Chacos Tacos Account service, website, or any related services (together, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service. Your continued use of the Service after any change to these Terms constitutes acceptance of the updated Terms.

The Service includes: (a) account registration and sign-in; (b) CT Member ID and CT Staff ID assignment and management; (c) for members: ordering (where integrated), order history, invoices, profile and settings, membership program and digital member card; (d) for staff: clock in/out, shifts, calendar, leave requests, and related tools; (e) any other features or content we make available from time to time. We may add, change, or discontinue parts of the Service with reasonable notice where required.

You must be at least 16 years old (or the age of legal capacity in your jurisdiction) to register. You provide accurate, current, and complete information when registering and keep it updated. You are responsible for maintaining the confidentiality of your password and for all activity under your account. One account per person; CT Member ID and CT Staff ID are non-transferable and may not be shared. We may refuse or suspend accounts that violate these Terms or for other legitimate reasons.

Upon registration you receive a unique identifier: a CT Member ID (for customers) or CT Staff ID (for employees). Your CT ID is used to sign in and to identify you across Chacos Tacos services. It remains linked to your account and must not be transferred or used by anyone else. Additional terms for the membership program and digital member card are available in your member area under Settings → CT ID → Memberships → Terms and conditions.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not: use the Service in any way that violates applicable law; impersonate others or provide false information; attempt to gain unauthorized access to any systems or other accounts; interfere with or disrupt the Service; scrape or automate access without our permission; or use the Service for any fraudulent or harmful purpose. We may suspend or terminate access for breach of this section.

Where the Service is used to place orders (e.g. for food or other products), the contract is between you and the relevant Chacos Tacos entity or outlet. Payment terms, cancellation, and refunds are governed by the terms displayed at the time of order and by applicable law. Invoices and order history in your account are for your reference; we strive for accuracy but do not guarantee that they are complete or error-free in all circumstances.

If you have a CT Member ID, you may participate in the Chacos Tacos membership and loyalty program. Points, tiers, benefits, and the digital member card are subject to the program rules and the dedicated terms available in your account at Member area → Settings → CT ID → Memberships → Terms and conditions. Those terms form part of your agreement with us for the program.

We process your personal data in accordance with our Privacy Policy and applicable data protection law. By using the Service you consent to such processing. We use your data to provide and improve the Service, to communicate with you, to comply with legal obligations, and for the purposes described in our Privacy Policy. You may have rights of access, rectification, erasure, restriction, portability, and objection; see our Privacy Policy and contact details for how to exercise them.

The Service, including text, graphics, logos, and software, is owned or licensed by Chacos Tacos (or its licensors) and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent, except as permitted by applicable law or these Terms.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.

To the fullest extent permitted by applicable law, Chacos Tacos and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or these Terms. Our total liability for any claims arising from or related to the Service or these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is greater. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless Chacos Tacos and its affiliates, officers, and employees from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your breach of these Terms, or your violation of any law or third-party rights.

We may suspend or terminate your account and access to the Service at any time, with or without notice, for breach of these Terms, for legal or regulatory reasons, or for operational needs. You may close your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases; provisions that by their nature should survive (including limitations of liability, indemnification, and governing law) will survive.

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes we may also notify you by email or through the Service. Your continued use of the Service after the effective date of the changes constitutes acceptance. If you do not agree, you must stop using the Service and may close your account.

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer protection law in your country requires otherwise.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms, together with the Privacy Policy and any program-specific terms accepted by you, constitute the entire agreement between you and Chacos Tacos regarding the Service. No agency, partnership, or employment relationship is created by these Terms.
